The Municipal Elections Act, 1996 requires anyone who has filed a nomination form, to file a financial statement with the Clerk by 2:00 p.m. on Friday March 31, 2023. Failure to comply means that you are subject to the penalties outlined below, in addition to any other penalty that may be imposed under the Municipal Elections Act.
Effect of default by candidate 88.23 (1) A candidate is subject to the penalties listed in subsection (2), in addition to any other penalty that may be imposed under this Act, a) if the candidate fails to file a document as required under section 88.25 or 88.32 by the relevant date; b) if a document filed under section 88.25 shows on its face a surplus, as described in section 88.31, and the candidate fails to pay the amount required by subsection 88.31(4) to the clerk by the relevant date; c) if a document filed under section 88.25 shows on its face that the candidate has incurred expenses exceeding what is permitted under section 88.20; or d) if a document filed under section 88.32 shows on its face a surplus and the candidate fails to pay the amount required by that section by the relevant date.
Penalties 88.23 (2) Subject to subsection (7), in the case of a default described in subsection (1), a) the candidate forfeits any office to which he or she was elected and the office is deemed to be vacant; and b) until the next regular election has taken place, the candidate is ineligible to be elected or appointed to any office to which this Act applies.
Offences by candidate 92 (1) A candidate is guilty of an offence and, on conviction, in addition to any other penalty that may be imposed under this Act, is subject to the penalties described in subsection 88.23(2) a) if the candidate incurs expenses that exceed the amount determined for the office under section 88.20; or b) if the candidate files a document under section 88.25 or 88.32 that is incorrect or otherwise does not comply with that section.
The information above is provided to all candidates; however it is the responsibility of the candidate to refer directly to the Municipal Elections Act, 1996 for specific provisions and additional details.
A nomination must be signed by the candidate and may be filed in person or by an agent by booking an appointment at the Municipal Office, during regular business hours between May 2, 2022, and August 18, 2022. On August 19, 2022 (Nomination Day) nominations can be filed between 9am and 2pm without an appointment. To book an appointment please email elections@pertheast.ca.
In accordance with the Municipal Elections Act, nominations must be filed using the prescribed forms, accompanied by the prescribed nomination filing fee, and nominations for an office on a council must be endorsed by at least 25 persons. The filing fee is $200.00 for the office of Mayor and $100.00 for Councillor. The filing fee is payable by cash, debit, certified cheque or money order. When collecting endorsement signatures, Candidates are encouraged to get more than 25 and to verify that all fields have been completed by each endorsee.
No person who proposes to be a candidate may solicit or accept contributions for election purposes or incur campaign expenses until a nomination paper has been filed.
Packages for interested candidates will be available for pick-up at the Municipal Office starting on May 2, 2022.
A candidate for municipal office must, upon nomination, be a qualified municipal elector and fulfil all of the following requirements:
A resident of the Township of Perth East, a non-resident owner or tenant of land in the Township of Perth East, or the spouse of such an owner or tenant
A Canadian Citizen
At least 18 years old
Not legally prohibited from voting
Not disqualified by any legislation from holding municipal office
Candidates for school board trustees must be a resident with the board area and a supporter of that board
Candidates can only be nominated for one office on a municipal council or school board in the Province of Ontario at a time. If a person is nominated for a second office, the first nomination is deemed to be withdrawn.
It is the responsibility of the candidate to determine whether he or she is qualified to be elected to and hold office.
Candidate Qualifications – School Board
A candidate for school board trustee must, upon nomination, be a qualified municipal elector and fulfil all of the following requirements:
A resident within the jurisdiction of the board
a supporter of the board
A Canadian Citizen
At least 18 years old
Not legally prohibited from voting
Not disqualified by any legislation from holding municipal office
Candidates can only be nominated for one office on a school board in the Province of Ontario at a time. If a person is nominated for a second office, the first nomination is deemed to be withdrawn.

The nomination period for individuals to register as candidates has changed as a result of recent amendments to the Municipal Elections Act. The nomination period now begins May 2nd and ends on August 19, 2022.
Nomination forms (Form 1) must be accompanied by an Endorsement of Nomination signed by 25 individuals who are a Canadian citizen, aged 18 or older and have a qualifying address in the municipality.
Complete Nomination forms (Form 1 and Form 2) will be accepted at the Municipal Office by appointment, located at 25 Mill St. E. Milverton, Ontario from:
May 2, 2022 to August 18, 2022 between the hours of 8:30 am – 4:30 PM and on Nomination Day, August 19, 2022 between 8:30 am –2:00 PM.
The last date to file nominations will be until 2:00 PM on Nomination Day, August 19, 2022.

Candidate Information Session - April 6, 2022 at 7:00 p.m.
Local Municipalities (The Town of St. Marys, City of Stratford, Municipality of North Perth, Township of Perth East, Township of Perth South and Municipality of West Perth) hosted a candidate information session for the 2022 Municipal and School Board Trustee elections.
This educational event took place on Wednesday April 6, 2022 at 7:00 p.m. at the Perth East Recreation Complex (40 Temperance Street, Milverton) as well as via Zoom.
The session was led by Jane Parnell and Caitlin Reddick, representatives from the Ontario Ministry of Municipal Affairs and Housing. Discussion topics included: the roles and responsibilities of elected officials and staff, eligibility rules, the nomination process, campaign finances, compliance audits, voters' list and voting proxy, scrutineers, recounts and resources.

Voter Information
Qualified Voters must be:
18 years of age or older;
A Canadian Citizen;
A resident of the Township of Perth East, or an owner or tenant of land in the Township or the spouse of an owner or tenant; and
Is not prohibited from voting under the Municipal Act or any other legislation.
The Township of Perth East will use Internet and Telephone Voting for the 2022 Municipal Election.
For a campaign period ending December 31, 2022, Financial Statements must be filed by all candidates on or before 2:00 p.m. on Friday, March 31, 2023, there is a 30 day grace period for late filing that includes a late filing fee of $500. If a candidate is not able to meet the deadline, he/she may apply to the Superior Court of Justice prior to the March 31st deadline for an extension.
Third Party Advertising
What is a Third Party Advertising?
Third party advertising refers to advertisements or other materials that support, promote or oppose a candidate, or support, promote or oppose a “yes or “no” answer to a question on the ballot.
Third party advertising is separate from any candidate's campaign, and must be done independently from a candidate. Any advertisements or materials that are made and distributed by a candidate, or under a candidate's direction, are part of the candidate's campaign.
Third party advertising is a way for those outside of the candidate's campaign to express support or opposition to candidates and to try to persuade voters to vote a certain way.
A third party advertisement is an advertisement in any broadcast, print, electronic or other medium that promotes, supports or opposes a candidate, or a “yes' or “no” answer to a question on the ballot. Advertisements include traditional ads as well as materials such as brochures or signs.
What is not a third party advertisement?
Activities that do not involve spending money, such as discussions or expressing an opinion about a candidate are not considered to be third party advertising. Examples include:
· Speaking to friends and neighbours
· Posting on social media, such as twitter, facebook or Instagram · Sending an email to a group or mailing list.
Who can be a third party advertiser?
Only those who have registered can spend money on third party advertising. The following are eligible to register as a third party advertiser:
· any person who is a resident in Ontario
· a corporation carrying on business in Ontario
· a trade union that holds bargaining rights for employee in Ontario
Who cannot be a third party advertiser?
A candidate running for any municipal council or school board office cannot registered to be a third party advertiser in any municipality.
Groups, associations or businesses that are not corporations are not eligible to register and may not spend money on third party advertising in municipal elections. For example, neighbourhood associations, clubs or professional associations cannot register and cannot make contributions to third party advertisers. Members may register as individual third party advertisers and may contribute individually.
Registration
An individual, corporation or trade union must be registered with the Municipal Clerk to be a third party advertiser in a municipality by completing a Notice of Registration – Third Party – Form 7. Being registered in a municipality allows the third party to advertise to the voters in that municipality. A third party advertiser can support or oppose any candidate or candidates who will be voted on by the people in that municipality. This includes candidates running for local council, school trustee and candidates running for offices on an upper tier council.
Compliance Audit Committee
Each municipality and school board must appoint a Compliance Audit Committee (CAC). The role of the Compliance Audit Committee is to receive and make decisions on applications for compliance audits of candidates' and registered third party election campaign finances. The CAC is also responsible for reviewing reports submitted by the Clerk with respect to any contributor who appears to have contravened any of the contribution limits to a candidate's election campaign or to a registered third party election campaign.

Candidate/Third Party Advertiser Financial Statements (2018)
The Township of Perth East is required to make Candidate's Financial Statements available for viewing by the public on a website or in another electronic format in accordance with the Municipal Elections Act, 1996.
Section 88.25 of the Municipal Elections Act requires a candidate to file the required statement in accordance with the Act, reflecting the candidate's election campaign finances from the 2018 municipal and school board election.

Are you on the voters' list?
The voters’ list is a list of eligible electors in the Township of Perth East. During an election cycle, the Municipal Property Assessment Corporation (MPAC) is responsible for preparing the preliminary list of electors for each municipality and school board in Ontario. It is MPAC’s Municipal Property Assessment database of property owners and tenants that is used to prepare this preliminary list, which aids in the preparation of the final voters’ list for Election Day.
It is important to check to see if your voter information is correct, especially if you have moved or changed your name since the last election. We encourage you to ensure that the Township of Perth East has the current voter information for you.
Alternatively, voters are able to attend the municipal office to complete the required Application to Amend Voters List link to EL15 form. To amend the list, you must have acceptable identification.
Identification Requirements
Acceptable Identification for voting purposes includes an Ontario driver's license, an Ontario Health Card, an insurance policy or statement or any other document included on the acceptable documents for voter identification list.

There have been significant changes to the Municipal Elections Act, 1996 and some of the processes and forms. This session will benefit new and returning candidates.
So, You Want to Run for Council? Commencing February 28, 2018, an online course to provide an overview of what you need to know before you decide to run for municipal office, and what you should know to begin your candidacy.
All third party advertisers must file a "Notice of Registration for Third Party Advertiser" Form and be certified by the Clerk.
Third Party Advertisers can be:
an individual who is normally a resident in Ontario
a corporation that carries business in Ontario
a trade union that holds bargaining rights for employees in Ontario
Ineligible third party advertisers are:
a candidate whose nomination has been filed
a Federal political party registered under the Canada Elections Act or any federal constituency association or registered candidate at a federal election endorsed by the party
a Provincial political party, constituency association, registered candidate or leadership contestant registered under the Election Finances Act
the Crown in right of Canada or Ontario, a municipality or local board
Contributions and expenses of the third party advertisers can only occur during the campaign period.
Campaign Period
Begins: the day the third party registers and is certified
Campaigning can begin once the Nomination Paper has been filed.
Campaigning materials are the responsibility of the candidate and must include the same name as shown on the Candidate's Nomination Form and the materials must NOT include the Township of Perth East logo or other insignia.
Materials shall not be placed on municipally-owned or leased properties.
The Clerk will calculate the maximum amount of campaign expenses that each candidate may incur and will provide a "Certificate of Maximum Campaign Expenses" Form to the candidate on or before September 26, 2022.
Financial Disclosure
Financial Statements- Auditor's Report must be filed at the Municipal office:
Before March 31, 2023 at 2:00 p.m.
Candidates, whose campaign contributions and total expenses are equal to or less than $10,000 are not required to file an auditor's report with the financial statement.
A registered third party advertiser whose expenses and/or contributions exceed $10,000 must file an auditor's report with the financial statement.
Preliminary List of Electors/Voter's List
All certified candidates are entitled to receive two (2) copies or an electronic format of the voters list and must sign a statement acknowledging that this list shall not be shared or used for purposes outside of the election.
Privacy
No person shall obtain or attempt to obtain information about how a voter intends to vote or has voted.
No person shall communicate any of the above information inadvertently obtained.
No person shall interfere or attempt to interfere with an elector during the voting process.
No elector shall reveal how they intend to vote (unless requesting support from a support person or election official).
Scrutineers
Scrutineers may be appointed in writing by the candidate to access a Candidate module showing voter sequence numbers and/or electors names entitled to vote for their designate officer. This module allows them to identify all the electors that have participated. Scrutineers must follow all instructions provided by the Clerk or election official, otherwise they can be requested to leave a Voter Help Centre and their appointment can be revoked.
Scrutineers and Candidates are prohibited from:
attempting directly or indirectly to interfere with how an elector votes
displaying campaign material at Voter Help Centres
compromising the secrecy of voting
interfering or attempting to interfere with an elector who is voting
obtaining or attempting to obtain information on how a voter intends to vote
Contributions to Registered Candidates
Contributions can only be accepted from an eligible contributor to a candidate or to an individual acting under the direction of the candidate.
Eligible Contributors:
an individual who normally resides in Ontario
the candidate and his/her spouse (whom reside in Ontario)- maximum contribution limits do not apply
Contributions exceeding $25 must be provided in a manner that associates their name and payment account information (NOT cash) with the contribution.
Contributions cannot exceed:
$1200 to any one candidate/office
$5000 to 2 or more candidates for office on the same council
Third Party Advertisers
A Registered Third Party Advertiser (RTPA) is an individual, corporation, or trade union that has registered with the municipality in order to publish advertisements during the municipal election in support of or in opposition to a candidate.
All individuals, corporations, or trade unions that intend to spend money to publish advertisements supporting or opposing a candidate must register with the municipality where they intend to publish advertisements. RTPAs are subject to expense limits between May 1, 2022, and October 21, 2022, and must file financial statements reflecting their activities during the campaign period.

Voting Help
THE VOTING PROCESS
Voting in the 2022 Township of Perth East Municipal Election will be by telephone or Internet. All eligible voters will receive a Voter Information Letter by mail. This sealed envelope will contain a Personal Identification Number (PIN) and a telephone access number and Internet address for voting. This allows voters to vote from the convenience of their own home or office. Contact information for Voter Help will also be included.
Voters will receive a Voter Information Letter that will include:
instructions on how to vote using the internet or telephone
unique PIN allowing each voter to vote once
dates and hours of voting
location and phone number of the Voter Help Centre
Should a voter receive more than one Voter Information Letter they must return the other letter(s) to the Township of Perth East Municipal Office – 25 Mill Street East, Milverton, Ontario, N0K 1M0.
Electors will be given an opportunity to change their vote before confirming the vote. The voting system allows voters to decline from voting if they wish.
The Clerk will report the "unofficial" results as soon as practical after the close of election at 8:30 p.m. on Monday, October 24, 2022 at the Perth East Recreation Complex (PERC), 40 Temperance Street, Milverton, Ontario.

A credit card statement, bank account statement, or RRSP, RRIF, RHOSP or T5 statement.
A CNIB Card or a card from another registered charitable organization that provides services to persons with disabilities.
A hospital card or record.
A document showing campus residence, issued by the office or officials responsible for student residence at a post-secondary institution.
A document showing residence at a long-term care home under the Long-Term Care Homes Act, 2007, issued by the Administrator for the home.
A utility bill for hydro, water, gas, telephone or cable TV or a bill from a public utilities commission.
A cheque stub, T4 statement or pay receipt issued by an employer.
A transcript or report card from a post-secondary school
Are you eligible to vote?
A person is entitled to be an elector if, on Voting Day, he or she:
is a Canadian citizen
is at least 18 years old
resides in the Township of Perth East, or is the owner or tenant of land in the Township of Perth East, or the spouse/same-sex partner of such a person; and
is not prohibited from voting under subsection 17(3) of the Municipal Elections Act, 1996 or otherwise, by law.
The following are prohibited from voting:
a person serving a prison sentence in a penal/correctional institution
a corporation
a person acting as an executor or trustee or in any other representative capacity
a person who was convicted of the corrupt practice described in subsection 90 (3), if voting day in the current election is less than 5 years after voting day in the election in which he or she was convicted
